Recall protests denied, Council to schedule recall election

Following a hearing last week, an independent hearing officer has denied all eight protests filed against the recall petition for District 1 Councilmember Paul Donahue. Now, per Town Charter and State Statutes, Town Council must set a recall election.

The Town’s Charter allows a petition to be circulated in attempt to recall a Town Councilmember within a certain timeframe. A group of petitioners have done so in an effort to recall Donahue. They obtained the required number of signatures, and those signatures were deemed sufficient by the Town Clerk.

Then, eight protests were filed to challenge the validity of the petition. Independent hearing officer Karen Goldman issued her decision about the protests Monday. Based on evidence presented during last Thursday’s hearing, Goldman found “no credible evidence of petition failure as part of any of the protests.” As a result, she confirmed the recall petition is sufficient.

As a result, Town Council will discuss during its regular meeting Tuesday night the date of a recall election. View the agenda online at CRgov.com/agendas. Council meetings are always broadcast live at CRgov.com/watch.

After the May 3 Council meeting, the Town will continue to update the community.

It’s important to note Donahue will continue to serve in office while this recall process takes place. Donahue was first elected in 2008, and most recently elected in 2012. His term will expire in November, and he is term-limited.
